THE CONFLICT PROBLEM: RESOLVABLE DILEMMAS
Still leaving the question of irresolvable dilemmas to one side, let us return to the ‘conflict problem’. Can deontology solve it, in resolvable cases, in a way that virtue ethics cannot? With respect to resolvable dilemmas, the deontologists’ strategy is to argue that the ‘conflict’ between the two rules which has generated the dilemma is merely apparent or prima facie. But the proponent of virtue ethics may employ the same strategy. According to her, too, many of the putative quandaries are merely apparent, resulting not from a conflict of deontological rules but from too clumsy an application of the virtue or vice terms. Does kindness require not telling hurtful truths? Sometimes, but in this case, what has to be understood is that one does people no kindness by concealing this sort of truth from them, hurtful as it may be. (An example might be a teacher’s telling a dedicated, mature student that, contrary to his hopes and dreams, he was not capable of postgraduate work in philosophy.)
Or, in a different case, the nature or importance of the truth in question puts the consideration of hurt feelings out of court, and it is not unkind, or callous, to speak out. (No one thinks a doctor unkind or callous because she tells her patients the shattering truth that they have only six months to live, though obviously it could be done in an unkind or callous way.) Does charity require that I kill the person who would be better off dead but who wants to say alive, thereby conflicting with justice? Not if, in Foot’s words, ‘a man does not lack charity because he refrains from an act of injustice which would have been for some one’s good. It is important to note here that none of these judgments amounts the comparative importance of the virtues in question; it is not being said that, for example, the virtue of honesty is more important than, or outranks, the virtue of kindness, nor that justice outranks charity. (I shall say more about this later)
