DILEMMAS AND REMAINDER
딜레마와 잔여
In current philosophical literature on the topic of dilemmas we find an odd split. There is, on the one hand, a large body of literature disputing the theoretical question of whether there are, or even could be, ‘irresolvable’ moral dilemmas. (An irresolvable moral dilemma is usually specified as a situation where doing x and doing y are equally wrong, but one has to do x or y, or one in which two moral requirements conflict but neither overrides the other (roughly).) Contained within the literature are related disputes about what the existence of irresolvable dilemmas does, or would entail, such as the falsity of moral realism or cognitivism (or, alternatively, their truth!), the failure of moral absolutism, the impossibility of a moral theory’s providing a decision procedure, and so on.
딜레마의 주제를 다루는 현재의 철학 문헌에서 우리는 이상한 분열을 발견하게 된다. 한쪽 편에는 ‘해결이 불가능한 도덕적 딜레마’ 라는 것이 존재하는가, 혹은 있을 수가 있는가, 라는 이론적 문제를 놓고 논쟁을 벌이는 많은 문헌들이 있다. Embedded in this literature is the important idea of ‘remainder’ or ‘residue’. Suppose there are irresolvable dilemmas and someone is faced with one. Then, whatever they do, they violate a moral requirement, and we expect them (especially when we think in terms of real examples) to register this in some way—by feeling distress or regret or remorse or guilt, or, in some cases, by recognizing that some apology or restitution or compensation is called for. This—the remorse or regret, or the new requirement to apologize or whatever—is called the (moral) ‘remainder’ or ‘residue’. Even when a dilemma is resolvable, one moral requirement clearly overriding the other, many writers want to insist that it is resolvable only ‘with remainder’; the overridden requirement retains its force in some way, so regret, or perhaps the recognition of a new requirement, are still appropriate.

On the other hand, there is an even larger body of literature in applied ethics on ‘hard cases’ (which are also called ‘dilemmas’) such as infanticide in the case of handicap, or abortion in the case of rape, or lying to the person in intensive care about the fact that she is the only member of her family to have survived the car accident, and so on. And a remarkable fact about this second body of literature is that it rarely, if ever, takes any notice of the first. Those who contribute to it (a) rarely even entertain the possibility that the dilemma they are discussing is irresolvable; on the contrary, they assume that there must be one, correct, decision to be made about it which it is the business of their moral theory—usually utilitarianism or deontology—to reveal or discover. And (b), concentrating exclusively on the question ‘Which is the right act in this case, x or y?’, they fail to say anything about ‘remainder’ or ‘residue’. Both (a) and (b) require discussion, and I shall begin with (b), leaving (a) until the next chapter.
