Irresolvable and Tragic Dilemmas
I take an irresolvable dilemma to be a situation in which the agent’s moral choice lies between x and y and there are no moral grounds for favouring doing x over doing y. We could also describe it as a situation in which the agent’s choice lies between x and y and nothing would counts as the reasonable practical answer to ‘Should I do x or y?’ Any putative example I gave at the outset would be bound to be controversial, for any particular situation I thought constituted an irresolvable dilemma could be one that someone else thought was to be resolved in a particular way, and some people think that there just aren’t any irresolvable dilemmas anyhow.
ARE THERE ANY IRRESOLVABLE DILMMAS?
I mentioned at the beginning of the last chapter that the contributors to the prevailing literature on hard cases in applied ethics ‘rarely even entertain the possibility that the dilemma they are discussing is irresolvable; on the contrary, they assume that there must be one, correct, decision to be made about it which it is the business of their moral theory…to reveal or discover’. Are there any irresolvable dilemmas? Are they justified in making this assumption? Well, there is justifiability according to one’s own lights, and justifiability tout court. I begin with the former.
Act utilitarians are, by and large, justified in making the assumption, according to their own lights. For, in so far as their theory basically eliminates the conflict problem, it eliminates irresolvable conflicts. It is true that the classical statement of the supreme utilitarian value, ‘the greatest happiness for the greatest number’, can be made to generate an irresolvable dilemma when each ‘greatest’ directs one differently and incompatibly. It is also true that A’s happiness and B’s happiness or suffering may be incommensurable, creating an irresolvable dilemma, and that a third sort may be presented by a case in which x and y are the only alternatives and each will produce exactly the same amount of suffering. But the fact is that the hard cases that are discussed in applied ethics are not, by and large, of any of these sorts; when they are not, the act utilitarian is, by her own lights, justified in her assumption that she can find the one right decision to be made about them. She thinks that, excepting a few arcane cases, moral life is pretty straightforward. However, the same is not true of deontologists.
