To this possible objection at least some deontologists respond by denying the necessity for the dependence. These are the deontologists who still subscribe to the strong codifiability thesis that I mentioned at the end of the last chapter. They suppose (a) that they have (or will be able to formulate in time) a complete and consistent set of rules in which second-order ranking rules or principles settle any conflicts among first-order rules, which have been formed with much more precision than the ‘mother’s-knee’ versions, and which may also be supposed to have had many necessary exception clauses built into them. Such a system would determine what was required in every situation and (b) would not rely on intuition or insight to resolve conflicts. It would, in Onora O’Neil’s nice description, ‘be an algorithm not just for some situations but for life’. So it seems that, at least in theory, deontology can solve the conflict problem in a way that virtue ethics cannot, without dependence on the dubious notion of ‘intuition’, or ‘exercise of judgment’.

Such deonologists presumably have a certain picture of what would count as an adequate normative ethics. According to this picture, and adequate normative ethics, one that is adequately action guiding, must be one that yields a decision procedure which can be used to resolve conflicts or settle moral quandaries without recourse to moral wisdom. Such a picture implicitly appeals to a certain test of adequacy of normative ethic which, at least on the face of it, act utilitarianism passes with flying colours, or it does indeed yield such a decision procedure. But, for several reasons, not all deontologists accept the production of an ‘algorithm for life’ independent of the exercise of judgment, as a suitable test of adequacy. Those who regard Kant’s ethics as ‘adequate’ may well reject it, for, as O’Neil notes, Kant himself insists that we can have no algorithm for judgment, since every application of a rule would itself need supplementing with further rules.
